The Corporate Manslaughter Act 2007
An organisation is guilty if a gross failure at a senior level causes the death of someone to whom they have a duty of care.
- Sentencing guidelines are expected soon but the Ministry of Justice guidance, referring to the record £15m fine that Transco received in 2005 following a fatal explosion, states; “Fines on this scale, and even higher, are of the sort that we would expect to see for corporate manslaughter”. The provision for a wide reaching publicity order could be far more damaging.
